These Terms of Use ("Terms") govern your access to and use of the MANTA wellness coaching service ("Service"), operated by MANTA ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Nature of the Service

MANTA is a wellness coaching service. It provides personalised insights and analysis based on your health, fitness, and nutrition data. The Service is intended for informational and educational purposes only.

MANTA is not a medical service. The insights provided by MANTA do not constitute medical advice, diagnosis, or treatment. You must not rely on MANTA's outputs as a substitute for professional medical advice. Always consult a qualified health professional regarding any health concerns or before making changes to your diet, exercise, or health regimen.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. The Service is intended for residents of Australia; use from other jurisdictions is at your own risk and subject to local laws.

3. Account and Access

During the early access phase, access to MANTA is provided via invitation only through Telegram. You are responsible for maintaining the confidentiality of your account access and for all activities that occur under your account.

You agree to provide accurate, current, and complete information when using the Service and to update that information as necessary.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to reverse engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorised access to any systems or networks connected to the Service.
• Share your account access with any other person.
• Use the Service to generate content that is misleading, harmful, or violates any applicable law.

5. Third-Party Integrations

The Service integrates with third-party platforms including Garmin Connect, Telegram, and others. Your use of those platforms is subject to their respective terms of service. By providing credentials or authorisation for third-party services, you represent that you have the right to do so and that such use complies with those platforms' terms.

6. Subscription and Pricing

MANTA is currently in an early access waitlist phase. No payment is required to join the waitlist. Founding member pricing (AU$19/month) will be offered to the first 50 members when the Service launches publicly. Pricing details and subscription terms will be provided at the time of account activation.

All prices are in Australian Dollars (AUD) and inclusive of applicable GST where required by law. Payments are processed securely by Stripe.

7. Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partially used billing periods except where required by Australian Consumer Law.

Your rights under the Australian Consumer Law (ACL) are not excluded by these Terms. If the Service is defective or not fit for purpose, you may be entitled to remedies under the ACL.

8. Intellectual Property

All content, software, algorithms, and materials provided through the Service are owned by or licensed to MANTA and are protected by Australian and international intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without our express written consent.

You retain ownership of all data you provide to the Service. By using the Service, you grant us a limited licence to process your data solely for the purpose of delivering the Service to you.

9. Data and Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you consent to the practices described in the Privacy Policy.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted operation.

MANTA does not warrant the accuracy, completeness, or reliability of any insights, analyses, or recommendations provided by the Service. Outputs are generated using AI and are subject to error.

11. Limitation of Liability

To the maximum extent permitted by law, MANTA's total liability to you for any claim arising under or in connection with these Terms or the Service is limited to the amount you paid to MANTA in the 3 months preceding the claim.

MANTA is not liable for any indirect, consequential, incidental, or special loss or damage arising from your use of the Service, including any reliance on insights or recommendations provided.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Australian law.

12. Changes to These Terms

We may update these Terms from time to time. We will notify active users of material changes via the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Victoria.
